The Supreme Court has mandated the city council to address waste management issues in Mykolaiv
The Supreme Court has supported the position of the prosecutor's office regarding the Mykolaiv City Council's obligation to take measures to resolve the issue of household waste management.
According to the regional prosecutor's office press service, the Supreme Court upheld the decision of the Fifth Appellate Administrative Court, which granted the prosecutor's appeal and deemed the inaction of the Mykolaiv City Council unlawful.
The court has ordered the city council to establish a sorting line for solid waste, develop a reclamation project for the existing landfill, and create a project for the construction of a new solid waste landfill.
The basis for the lawsuit was the failure of the Mykolaiv City Council to implement the City Target Program for household waste management, approved in 2019. This led to the expiration of the operational period of the existing landfill, which has been in operation since 1972 and reached its capacity in 2022.
However, despite the court's ruling, the city council filed a cassation appeal to the Supreme Court of Ukraine in an attempt to evade its obligations.
"Thanks to the principled stance of the prosecutor's office, important steps have been taken to address the environmental issue that affects the interests of all city and regional residents," the statement said.
