Drunk driver crashed into a fence and threatened the homeowner with grenades: Voznesensk court released the troublemaker

The Voznesensk District Court of Mykolaiv region sentenced a resident of the village of Kovalivka to probation after he crashed into a property fence while intoxicated and then attempted to "resolve the situation" by threatening the homeowner with grenades.

This is stated in the court ruling published in the Unified State Register of Court Decisions on October 14.

The case materials indicate that on the night of February 29, around 1:30 AM, the defendant, in an inebriated state, was driving a Skoda Fabia along Tsvetkova Street in the village of Novosilka. Losing control, he veered off the road and crashed into the property fence, creating a hole. Hearing the noise, the homeowner rushed out to the yard and, upon seeing the drunken offender, forbade him from using the car and sent him home.

Afterward, the suspect developed a criminal intent: to "settle the incident," he took F-1 grenades, illegally entered the yard through the hole made by his car, and began to threaten the homeowner.

“Subsequently, the suspect formed a criminal intent aimed at illegally entering the property to resolve the conflict, exert psychological pressure on the homeowner, and retrieve the vehicle. Acting on this intent, the suspect, at a location not established during the pre-trial investigation, took military-grade explosive devices – defensive fragmentation hand grenades F-1 and went to the property,” the case materials state.

At around 1:50 AM, the defendant entered the yard and initiated a quarrel with the homeowner, during which he pulled grenades F-1 from his pocket and threatened to use them. However, the homeowner seized the opportunity, yanked the explosive devices from the troublemaker's hands, and secured them until the police arrived.

It is noted that according to the examination results, the grenades the suspect threatened the victim with were real.

During the court proceedings, the defendant admitted his guilt and expressed remorse for his actions. Furthermore, it was reported that the man had no prior convictions, was unemployed, and had two minor children under his care.

“According to the probation authority, serving the sentence in the community is possible provided that supervision is exercised and socio-educational measures necessary for correction and prevention of repeated criminal offenses are applied,” the ruling states.

The suspect was found guilty of the charges brought against him for committing criminal offenses under part 1 of Article 263 (imprisonment for up to 5 years), part 1 of Article 162 (imprisonment for up to 2 years), and part 1 of Article 129 (imprisonment for up to 2 years) of the Criminal Code of Ukraine.

According to part 1 of Article 70 of the Criminal Code of Ukraine, given the accumulation of criminal offenses, the defendant could have been sentenced to imprisonment for up to 5 years. However, ultimately, the judge of the Voznesensk District Court decided to release the accused from punishment with a 3-year probation period.

He was required to periodically report to the authorized probation authority; notify of any changes in residence, employment, or education; and not leave the territory of Ukraine without permission.
