The former head of the Brovary District State Administration, Vladimir Maibozhenko, was involved in a car accident in Brovary in April last year while under the influence of alcohol, hitting four people at a crosswalk, including a two-year-old child. The Brovary District Court of Kyiv region ordered him to pay a fine of 34,000 hryvnias and banned him from driving for 3 years, reports Brovarymedia.
Journalists report that according to the ruling announced by Brovary Court Judge Tatyana Vasylenko, Maibozhenko must pay a fine of 34,000 UAH and 31,432 UAH in court costs. He will also lose his driving privileges for three years.
Additionally, the former head of the RGA is to have his "Volvo" car returned, which has been stored at the impound lot since the accident occurred.
The Kyiv regional prosecutor's office stated that they disagree with the ruling of the Brovary District Court, which approved the reconciliation agreement between the former head of the Brovary RGA and the victims, and they will insist on overturning the decision in the appellate court.
According to the prosecutor's office, the defendant's attorney submitted a reconciliation agreement to the court, under which the parties conditioned the penalty using part 1 of Article 69 of the Criminal Code of Ukraine: imposing a milder punishment than that provided by law.
"The prosecutor submitted a written objection regarding the impossibility of concluding a reconciliation agreement in cases of this category, as well as the inconsistency of the agreement's provisions with the interests of society and the requirements of the Criminal Code of Ukraine," the agency's press service stated.
It was also reported that the court denied the prosecutor's request to examine case materials that refute the presence of mitigating circumstances.
"Due to the existence of circumstances that raise doubts about the impartiality of the court, a motion was filed to remove the presiding judge, which was denied," the prosecutor's office noted.
On April 26, media reported that in the city of Brovary, Kyiv region, a drunk RGA chairman drove into a crowd. Four people were reported injured.
On the same day, the head of the Kyiv regional military administration, Ruslan Kravchenko, stated that the head of the Brovary District State Administration, Vladimir Maibozhenko would be dismissed following the "horrific incident" in Brovary, which involved 3 adults and one child. The Office of the Prosecutor General of Ukraine reported that Maibozhenko had been detained and was being assigned a preventive measure.
Ruslan Kravchenko also clarified that among the injured in the Brovary accident was a mother with her two-year-old daughter. The child was diagnosed with a fractured humerus and a subcutaneous hematoma on the back of the head.
On the evening of April 26, the communications department of the Main Directorate of the National Police in Kyiv region reported the arrest of RGA chairman Maibozhenko. Testing with a Drager device showed 2.31 promille of alcohol in his blood, which is significantly above the legal limit.
On April 27, Maibozhenko was informed of the suspicion of violating traffic regulations while under the influence of alcohol. He was ordered to be held in custody without the right to bail for two months.
Also on April 27, Ukrainian President Volodymyr Zelensky signed an order dismissing Vladimir Maibozhenko from his position as head of the Brovary District Military Administration for hitting people on the crosswalk.
It is worth noting that on January 27, in Kharkiv, people said their goodbyes to blogger Anna Zhuk, who died in a car accident on the Kyiv — Kharkiv — Dovzhansky highway. The car, in which Anna was traveling with her husband, collided with a truck on January 24.
