"Demobilization is impossible": Ukraine calls on a reserved worker; who is to blame for this situation?

Member of Parliament Alexander Fedienko has made public the response from the Territorial Recruitment Center regarding his inquiry about the mobilization of a conscripted employee, despite having a deferment. According to him, this incident demonstrates that even a salary of one hundred thousand is not a guarantee that a reserved worker will not be called up for service.

In Ukraine, a reserved worker has been mobilized. The Territorial Recruitment Center (TRC) provided an official response regarding the incident. This was reported on January 6 by Alexander Fediienko, a member of parliament from the "Servant of the People" party.

"So now it is possible to cancel the deferment for an employee of a critically important enterprise without even considering that he was reserved. Furthermore, the note states that the Mykolaiv Regional Center for Recruitment and Social Support operates within the framework of current legislation. The main issue here is that such a person cannot be demobilized now," he noted.

The parliamentarian emphasized that the critical enterprise is losing an important worker, and the entire reservation system loses trust from the employer, who has obtained his status legally and reserved employees.

"You can set the salary at even a hundred thousand, but you won't be able to protect your worker from further mobilization," Fediienko concluded.

The published document, parts of which are redacted, states that the workers were reserved by an enterprise that is deemed critically important during a special period. By the order of the head of the Mykolaiv District TRC, they were called in for data updates and to undergo a military medical commission (MMC). After that, they were mobilized.

However, it is noted that "the officials who canceled the deferment" did not take the reservation into account, rather than the executor of the mobilization order. Nevertheless, the MP was assured that the Mykolaiv TRC "acts solely on the basis, within the powers, and in the manner provided by the Constitution and laws of Ukraine."

What is the role of the TRC in canceling deferments

As noted in an article on the Dnipropetrovsk Regional Administration's website, the mobilization order is established for enterprises, institutions, and organizations. This order is issued by a state body, most often regional or district military administrations.

The press service of the Lopushenska community in the Ternopil region explained that the cancellation of the deferment is carried out by the decision of the Ministry of Economy. State bodies, local self-government bodies, enterprises, institutions, and organizations have five days from that moment to retrieve the deferment certificate from the military liable and send it to the TRC where the worker is registered.

Lawyers in a material for "LIGA ZAKON" noted that the TRC is an agency that only registers military liable individuals for special accounting and can refuse in this procedure if there was an error in the reservation decision. The military commissariats do not have the authority to cancel deferments; this is handled by the Ministry of Economy.
